Terms of the Agreement

This Membership Agreement (“Agreement”) is legally binding between the individual named in the sign-up application (“Member”, “You”, or “Your”) and HSF Wellness (“the Company”, “We”, “Our”, or “Us”). By signing this Agreement, executing a membership plan on our website (https://hsfwellness.com), or utilizing our facilities, you explicitly agree to fulfill all obligations, terms, and rules outlined below.

1. Membership Term and Automatic Renewal

  • Initial Term: Your membership begins on the designated Membership Start Date and continues for the fixed period selected during registration (e.g., Month-to-Month, 3 Months, or 12 Months).
  • Automatic Renewal: Upon expiration of the Initial Term, your membership will automatically renew on a month-to-month basis at our prevailing dues rate, unless you provide a written notice of cancellation exactly thirty (30) days prior to your next scheduled billing date.

2. Payment Schedule and Financial Obligations

  • Billing and Drafts: You authorize HSF Wellness (and our designated payment processors) to securely store your payment information and automatically debit your account for recurring membership dues, taxes, and applicable club fees on your fixed billing cycle date.
  • Sufficient Funds: It is your absolute responsibility to ensure that adequate funds are available in your billing account on your designated draft date. If your billing date falls on a weekend or public holiday, your account may be drafted on the immediately preceding business day.
  • Default and Delinquency: You will be in default if your payment fails or if any dues remain unpaid for thirty (30) days past their scheduled due date. If you are in default, HSF Wellness reserves the right to suspend or terminate your gym access. Suspension of club access does not release you from your obligation to pay your remaining contract balance.
  • Chargebacks and Failed Fees: Any bank fees, overdraft charges, or processing fees incurred by HSF Wellness due to failed transactions, insufficient funds, or unauthorized credit card chargebacks will be charged back to the Member and must be paid in full to restore account standing.

3. Rules, Regulations, and Facility Access

  • Right of Refusal: HSF Wellness operates private fitness and wellness facilities. We reserve the absolute right to admit, refuse entry to, or revoke the access privileges of anyone at any time in our sole discretion.
  • Compliance with Club Rules: Members must fully comply with all posted rules, regulations, hygiene guidelines, dress codes (proper athletic attire and closed-toe athletic shoes required), and code of conduct policies.
  • Prohibited Conduct: Loud, offensive, abusive, or dangerous behavior, use of profanity, damaging equipment, or dropping weights is strictly prohibited. Furthermore, no member may solicit or perform independent personal training services on HSF Wellness premises. Infractions will result in immediate expulsion and potential termination of membership without a refund.
  • Membership Credentials: Your digital check-in or physical membership card/barcode is strictly non-transferable. Loaning your access credentials to a third party or allowing unauthorized individuals into the facility will result in immediate termination of your membership and a permanent ban.

4. Freezing, Changes, and Cancellation Policies

  • Early Termination Fee: If you choose to terminate a fixed-term commitment plan (such as a 12-Month contract) prior to fulfilling your Initial Term, you agree to pay an Early Termination Fee of [Insert Amount, e.g., $150 or Local Currency Equivalent] to break the contract early.
  • Process for Account Modifications: Account freezes, membership upgrades, downgrades, or cancellations can only be requested if your account is currently in good standing with no outstanding balances.   • Unused Portions: Unused portions of “Paid in Full” or upfront memberships are non-refundable.

5. Health and Physical Condition Representations

By checking in or entering an HSF Wellness facility, you represent, warrant, and guarantee that you are in good physical condition and have no known medical impairments, conditions, or reasons that could prevent you from safely using our fitness equipment or participating in our programs.

Important Notice: You acknowledge that HSF Wellness and its staff have not given you medical advice and are not qualified to do so. It is highly recommended that you consult a physician before beginning any new exercise or wellness regimen.

6. Assumption of Risk and Liability Waiver

  • Personal Injury: You explicitly acknowledge and understand that physical fitness training, group classes, and utilizing heavy machinery or gym equipment involve inherent risks of physical injury, including severe injury or death. You voluntarily assume all risks associated with your use of HSF Wellness facilities. You agree to hold harmless HSF Wellness, its owners, officers, directors, employees, and agents from any and all claims, liabilities, or damages arising out of personal injury or illness suffered on our premises.
  • Personal Property: HSF Wellness is not liable to members, guests, or invitees for any personal property that is lost, damaged, damaged by water, or stolen while on or around our premises (including inside lockers or in adjacent parking areas). Property left in lockers overnight will be removed and discarded.
  • Damage to Facilities: You agree to be financially responsible for any structural or equipment damage caused to HSF Wellness facilities by you or your registered guests due to negligence or willful misconduct.

7. General Legal Terms

  • Modification of Services: HSF Wellness reserves the right to adjust its operational hours, eliminate or add equipment, alter available class schedules, modify membership types, or change specific club amenities at any time at its sole discretion without prior notice.
  • Governing Law: This Agreement is governed by and construed in accordance with the laws of the jurisdiction in which the HSF Wellness facility you registered with is located. If any provision of this contract is found to be invalid or unenforceable, the remaining terms shall continue in full force and effect.
